Términos y Condiciones de Alquiler de Bicicletas / Bike Rental Terms and Conditions
1. Contrato de Alquiler:
Al alquilar una bicicleta de RideNerja usted acepta regirse por los
términos y condiciones establecidos en este acuerdo y en el
Contrato de Alquiler de Bicicletas que firmó.
2. Responsabilidad del Ciclista:
Usted es responsable de la conducción segura de la bicicleta
durante el período de alquiler.
Debe obedecer todas las leyes y reglamentos viales.
Debe usar casco en todo momento mientras conduce la bicicleta.
Usted es responsable de cualquier daño causado a la bicicleta o a
usted mismo debido a un uso inadecuado.
3. Usos Prohibidos:
Las bicicletas son solo para uso recreativo y no se pueden utilizar
con fines comerciales.
Las bicicletas no se pueden conducir bajo la influencia de drogas
o alcohol.
Las bicicletas no se pueden usar para transportar más pasajeros
de los diseñados.
4. Inspección y Condición:
Se le dará la oportunidad de inspeccionar la bicicleta antes de que
comience su alquiler.
Cualquier daño preexistente debe anotarse en el formulario de
alquiler.
Usted es responsable de informar cualquier daño que ocurra
durante el período de alquiler de inmediato.
5. Depósito de Seguridad:
Se requerirá un depósito de seguridad de 50 euros por bicicleta
al momento del alquiler. El depósito se reembolsará a la
devolución de la bicicleta en las mismas condiciones en que se
alquiló.
6. Período de Alquiler y Cargos por Retraso:
El período de alquiler comienza en el momento de la recogida y
finaliza a la hora de devolución acordada.
Las devoluciones tardías se cobrarán con una tarifa adicional de
20 euros por hora.
7. Cancelaciones:
Las cancelaciones realizadas 48h antes de su fecha de recogida
recibirán un reembolso completo.
Las cancelaciones realizadas en las 24h antes de su fecha de
recogida perderán la totalidad del costo del alquiler.
8. Pérdida o Robo:
Usted es responsable de la bicicleta durante el período de alquiler.
En caso de pérdida o robo, usted será responsable del costo total
de reemplazo de la bicicleta eléctrica.
9. Seguro:
La bicicleta está cubierta por un seguro de responsabilidad civil.
Sin embargo, es posible que este seguro no cubra todos los
daños. El cliente tiene toda la responsabilidad sobre todo tipo de
daños que produce a sí mismo y a terceros. RideNerja no se hace
responsable de reclamaciones por accidentes, heridas, golpes o
daños ocasionados a sí mismos o a su propiedad.
10. Renuncia de Garantías:
Las bicicletas eléctricas se alquilan «tal cual» y RideNerja no
ofrece garantías, expresas o implícitas, con respecto a la
seguridad o el estado de la bicicleta eléctrica.
11. Indemnización:
Usted acepta indemnizar y mantener indemne a RideNerja de y
contra cualquier reclamo, responsabilidad, pérdida, daño, costo y
gasto (incluidos los honorarios de abogados) que surjan de o
estén relacionados con su uso de la bicicleta.
12. Ley Aplicable:
Este acuerdo se regirá e interpretará de conformidad con las leyes
españolas.
13. Acuerdo Completo:
Este acuerdo constituye el acuerdo completo entre usted y
RideNerja con respecto a la materia del presente y reemplaza
todas las comunicaciones, representaciones o acuerdos anteriores
o contemporáneos, ya sean orales o escritos.
14. Divisibilidad:
Si alguna disposición de este acuerdo se considera inválida o
inaplicable, dicha disposición se eliminará y las disposiciones
restantes permanecerán en pleno vigor y efecto.
Al alquilar una bicicleta de RideNerja usted reconoce que ha leído,
entendido y acepta estar sujeto a estos términos y condiciones.
1. Rental Agreement:
By renting a bike from RideNerja you agree to be bound by the
terms and conditions set forth in this agreement and the Bike
Rental Agreement you signed.
2. Rider Responsibility:
You are responsible for the safe operation of the bike during the
rental period.
You must obey all traffic laws and regulations.
You must always wear a helmet while riding the electric bike.
You are responsible for any damage caused to the electric bike or
yourself due to improper use.
3. Prohibited Uses:
Our bikes are for recreational use only and cannot be used for
commercial purposes.
Bikes cannot be ridden under the influence of drugs or alcohol.
Bikes cannot be used to carry more passengers than designed for.
4. Inspection and Condition:
You will be given the opportunity to inspect the electric bike before
your rental begins.
Any pre-existing damage must be noted on the rental form.
You are responsible for reporting any damage that occurs during
the rental period immediately.
5. Security Deposit:
A security deposit of 50 euros per bike will be required at the time
of rental. The deposit will be refunded upon the safe return of the
electric bike in the same condition it was rented, minus any
applicable charges.
6. Rental Period and Late Fees:
The rental period begins at the time of pick-up and ends at the
agreed-upon return time.
Late returns will be charged an additional fee of 20 euros per hour.
7. Cancellations:
Cancellations made 48h prior to your pick up date will receive a full
refund.
Cancellations made 24h prior to your pick up date will forfeit the
entire rental fee.
8. Loss or Theft:
You are responsible for the electric bike during the rental period.
In the event of loss or theft, you will be responsible for the full
replacement cost of the electric bike.
9. Insurance:
The electric bike is covered by liability insurance. However, this
insurance may not cover all damages. The customer bears full
responsibility for all types of damage caused to himself and to third
parties. RideNerja is not responsible for claims for accidents,
injuries, blows or damage caused to themselves or their property.
10. Disclaimer of Warranties:
Electric bikes are rented «as is» and RideNerja makes no
warranties, express or implied, regarding the safety or condition of
the electric bike.
11. Indemnification:
You agree to indemnify and hold harmless RideNerja from and
against any and all claims, liabilities, losses, damages, costs, and
expenses (including attorney’s fees) arising out of or related to
your use of the electric bike.
12. Governing Law:
This agreement will be governed by and construed in accordance
with the Spanish laws.
13. Entire Agreement:
This agreement constitutes the entire agreement between you and
[Your Business Name] with respect to the subject matter hereof
and supersedes all prior or contemporaneous communications,
representations, or agreements, whether oral or written.
14. Severability:
If any provision of this agreement is held to be invalid or
unenforceable, such provision shall be struck and the remaining
provisions shall remain in full force and effect.
By renting an electric bike from RideNerja, you acknowledge that
you have read, understood, and agree to be bound by these terms
and conditions
